Reading Fern Terms of Use

These Terms of Use (“Terms”) govern your use of ReadingFern.com (the “Website”) and digital artwork, printable products, downloads, emails, and other materials provided by Reading Fern (“Products” or “Materials”).

By using the Website or downloading, purchasing, or using a Reading Fern Product, you agree to these Terms. If you do not agree, please do not use the Website or Products.

1. About Reading Fern

Reading Fern creates personalized book art, printable bookplates, and other thoughtful digital goods inspired by books, reading memories, and personal libraries.

2. Digital Products

Unless a product listing specifically states otherwise, Reading Fern digital Products are delivered electronically. No physical product, print, frame, book, sticker, or other physical item will be shipped.

Product photographs and mockups are provided to demonstrate possible ways a digital Product may look when printed, framed, displayed, or used. Frames, books, paper, decorative objects, and other items appearing in mockups are not included unless expressly stated.

Actual printed appearance may vary depending on the printer, paper, ink, monitor settings, and printing service used.

3. Personalized Products

Some Reading Fern Products are personalized using information supplied by the customer, such as book titles, names, or years.

Customers are responsible for reviewing the spelling and accuracy of information submitted for personalization.

Reading Fern will correct errors made by Reading Fern when entering customer-provided information. Changes requested because incorrect information was originally submitted by the customer may not be available after work has begun.

Unless specifically stated in a product listing, personalization does not include changes to the underlying artwork, colors, typography, composition, decorative elements, or overall design.

Turnaround times for personalized Products are stated in the applicable product listing and may vary.

4. Ownership and Intellectual Property

Unless otherwise stated, the Reading Fern Website, branding, logos, written content, original layouts, product designs, and downloadable files are owned by or licensed to Reading Fern and are protected by applicable intellectual-property laws.

Purchasing or downloading a Product grants you a limited license to use that Product as described in these Terms. It does not transfer ownership of the Product or Reading Fern's intellectual property to you.

Reading Fern Products may incorporate licensed, public-domain, or other lawfully usable source material. Rights in third-party material, where applicable, remain with their respective rights holders.

“Reading Fern,” the Reading Fern logo, and related brand elements may not be used to market, identify, or promote another person's products, services, or business without prior written permission.

5. Personal-Use License

Unless a product listing expressly states otherwise, Reading Fern Products are licensed for personal, non-commercial use only.

You may:

• Download and save your purchased files for your own personal use
• Print reasonable copies for your own personal use
• Display printed Reading Fern artwork in your home or personal space
• Use printable bookplates in books from your own personal library
• Give a finished physical print or personalized piece as a personal gift, provided the digital file itself is not distributed

Your purchase does not grant commercial, resale, redistribution, sublicensing, or merchandising rights.

6. Uses Not Permitted

Unless Reading Fern gives prior written permission, you may not:

• Resell, redistribute, share, sublicense, or give away Reading Fern digital files
• Upload files to websites, shared drives, social-media groups, marketplaces, file-sharing services, or other locations where others may download or copy them
• Sell printed copies of Reading Fern Products
• Use Reading Fern Products in merchandise or products offered for sale
• Claim Reading Fern artwork, designs, files, branding, or written content as your own
• Remove Reading Fern copyright notices or branding where included
• Copy or extract elements from Reading Fern Products for use in another product or design
• Modify Reading Fern Products for resale or redistribution
• Use Reading Fern Products or Website content to train, develop, or create datasets for artificial-intelligence or machine-learning systems
• Use Reading Fern branding in advertising, merchandise, or unrelated products without written permission

If you are interested in a use not covered by this license, please contact Reading Fern before using the Product.

7. Book Titles and Customer-Provided Information

Personalized Reading Fern artwork may incorporate book titles, names, dates, or other short information supplied by the customer.

Reading Fern's inclusion of a book title in personalized artwork does not imply affiliation with, sponsorship by, or endorsement from the book's author, publisher, rights holder, or any related company.

Reading Fern personalized book artwork does not reproduce original book covers, publisher artwork, logos, or other protected visual elements unless Reading Fern has the appropriate right or permission to do so.

Customers should not request personalization containing material they do not have the right to provide or that would violate applicable law or another person's rights.

8. Purchases, Delivery, and Refunds

Reading Fern Products may be sold through third-party marketplaces such as ​Etsy​. Purchases made through a third-party marketplace are also subject to that marketplace's applicable terms, policies, payment procedures, delivery methods, and refund rules.

Instant-download Products are generally available electronically after payment has been processed by the applicable marketplace.

Personalized digital Products are delivered according to the turnaround time and delivery method stated in the applicable listing.

Because digital and personalized Products cannot generally be returned in the same manner as physical goods, returns, cancellations, and refunds may be limited, subject to applicable law and the policies of the marketplace through which the purchase was made.

If a Reading Fern file is defective, incomplete, inaccessible, or contains an error made by Reading Fern, please contact Reading Fern so the issue can be reviewed and, when appropriate, corrected.

Prices, availability, and Product offerings may change without notice.

9. Email Communications

You may choose to subscribe to Reading Fern emails to receive new product releases, reader finds, occasional bookish content, shop updates, and special offers.

Subscribing to Reading Fern marketing emails is voluntary. Purchasing a Reading Fern Product does not automatically subscribe you to the Reading Fern marketing email list.

You may unsubscribe from marketing emails at any time using the unsubscribe link included in our emails.

Reading Fern uses ​Kit​ to manage its email list and communications.

10. Third-Party Websites and Services

The Website may contain links to third-party websites and services, including Etsy, Pinterest, email providers, or other platforms.

Reading Fern does not control third-party services and is not responsible for their content, availability, privacy practices, policies, or terms.

Your use of a third-party service is subject to that service's own terms and policies.

11. Website Availability and Changes

Reading Fern may update, replace, suspend, or discontinue Website content or Products at any time.

Reading Fern does not guarantee that the Website, every Product, or every download link will always be available, uninterrupted, secure, or error-free.

Reasonable efforts will be made to address reported technical issues.

12. Disclaimer of Warranties

To the extent permitted by law, the Website and Reading Fern Products are provided “as is” and “as available,” without warranties of any kind, express or implied.

Reading Fern does not guarantee that digital Products will appear identical on every monitor, printer, paper type, device, or printing service.

Reading Fern also does not guarantee any particular aesthetic, commercial, financial, or other result from the use of its Website or Products.

13. Limitation of Liability

To the extent permitted by law, Reading Fern and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Website or Reading Fern Products.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, or expenses arising from your misuse of the Website or Products, your violation of these Terms, or your infringement of another person's rights.

15. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.

Any dispute will be handled in the state or federal courts located in Kansas unless applicable law requires otherwise.

16. Changes to These Terms

Reading Fern may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date.

Your continued use of the Website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
